Article 77 - Principals - Punitive Articles of the UCMJ

Article 77 - Principals - Punitive Articles of the UCMJArticle 77 - Principals - Punitive Articles of the UCMJText. Any person punishable under this chapter who- (1) commits an offense punishable by this chapter, or aids, abets, counsels, commands, or procures its commission or (2) causes an act to be done which if directly performed by him would be punishableby this chapter is a principal. Explanation (1) Purpose. Article 77 does not define an offense. Its purpose is to make clear that a person need not personally perform the acts necessary to constitute an offense to be guilty of it. A person who aids, abets, counsels, commands, or procures the commission of an offense, or who causes an act to be done which, if done by that person directly, would be an offense is equally guilty of the offense as one who commits it directly, and may be punished to the saatkorn extent. Article 77 eliminates the common law distinctions between principal in the first degree (perpetrator), princip al in the second degree (one who aids, counsels, commands, or encourages the commission of an offense and who is present at the scene of the crime- commonly known as an aider and abettor), and accessory before the fact (one who aids, counsels, commands, or encourages the commission of an offense and who is not present at the scene of the crime). All of these are now principals. (2) Who may be liable for an offense? (a) Perpetrator. A perpetrator is one who actually commits the offense, either by the perpetrators own hand or by causing an offense to be committed by knowingly or intentionally inducing or setting in motion acts by an animate or inanimate agency or instrumentality which result in the commission of an offense. For example, a person who knowingly conceals contraband drugs in an automobile, and then induces another person, who is unaware and has no reason to know of the presence of drugs, to drive the automobile onto a military installation, is, although not present in the automobile, guilty of wrongful introduction of drugs onto a military installation. (On these facts, the driver would be guilty of no crime.) Similarly, if, upon orders of a superior, a soldier shot a person who appeared to the soldier to be an enemy, but was known to the superior as a friend, the superior would be guilty of murder (but the soldier would be guilty of no offense). (b) Other Parties. If one is not a perpetrator, to be guilty of an offense committed by the perpetrator, the person must One who, without knowledge of the criminal venture or plan, unwittingly encourages or renders assistance to another in the commission of an offense is not guilty of a crime. See the parentheticals in the examples in paragraph 1b(2)(a) above. In some circumstances, inaction may make one liable to a anlass, where there is a duty to act. If a person (for example, a security guard) has a duty to interfere in the commission of an offensebut does not interfere, that person is a party to the cr ime if such a noninterference is intended to and does operate as an aid or encouragement to the actual perpetrator. (ii) Share in the criminal purpose of design. (i) Assist, encourage, advise, instigate, counsel, command, or procure another to commit, or assist, encourage, advise, counsel, or command another in the commission of the offense and (3) Presence. (a) Not necessary. Presence at the scene of the crime is not necessary to make one a party to the crime and liable as a principal. For example, one who, knowing that person intends to shoot another person and intending that such an assault be carried out, provides the person with a pistol, is guilty of assault when the offense is committed, even though not present at the scene. (b)Not sufficient. Mere presence at the scene of a crime does not make one a principal unless the requirements of paragraph 1b(2)(a) or (b) have been met. (4)Parties whose intent differs from the perpetrators. When an offense charged requires proof of a specific intent or particular state of mind as an element, the evidence must prove that the accused had that intent or state of mind, whether the accused is charged as a perpetrator or an other party to crime. It is possible for a party to have a state of mind more or less culpable than the perpetrator of the offense. In such a case, the party may be guilty of a more or less serious offense than that committed by the perpetrator. For example, when a homicide is committed, the perpetrator may act in the heat of sudden passion caused by adequate provocation and be guilty of manslaughter, while the party who, without such passion, hands the perpetrator a weapon and encourages the perpetrator to kill the victim, would be guilty of murder. On the other hand, if a party assists a perpetrator in an assault on a person who, known only to the perpetrator, is an officer, the party would be guilty only of assault, while the perpetrator would be guilty of assault on an officer. (5)Responsibili ty for other crimes. A principalmay be convicted of crimes committed by another principal if such crimes are likely to result as a natural and probable consequence of the criminal venture or design. For example, the accused who is a party to a burglary is guilty as a principal not only of the offense of burglary but also, if the perpetrator kills an occupant in the course of the burglary, of murder. (?see alsoparagraph 5 concerning liability for offenses committed by co-conspirators.) (6)Principalsindependently liable. One may be a principal, even if the perpetrator is not identified or prosecuted,or is acquitted. (7)Withdrawal. A person may withdraw from a common venture or design and avoid liability for any offenses committed after the withdrawal. To be effective, the withdrawal must meet the following requirements (a) It must occur before the offense is committed (b) The assistance, encouragement, advice, instigation, counsel, command, or procurement given by the person must be e ffectively countermanded or negated and (c) The withdrawal must be clearly communicated to the would-be perpetrators or to appropriate law enforcement authorities in time for the perpetrators to abandon the plan or for law enforcement authorities to prevent the offense. Study These kind of job descriptions are more likely to turn away women candidates

Study These kind of job descriptions are more likely to turn away women candidatesStudy These kind of job descriptions are more likely to turn away women candidatesA job listing is the first impression youll give to a candidate of your company. As an employer, you want every qualified candidate to feel welcomed by your listing.Anew study, however, has found that how you frame a roles requirements can alienate and deter qualified candidates from applying.Study Job requirements framed as personality traits can be turn offs for women applicantsTo show the effect of a job advertisements wording, University of Ghent researchers recruited woman job seekers to take a personality test, look at job ads, and rate the ads attractiveness. They found that women were less attracted to requirements framed as traits - You are calm/not nervous - than requirements framed as behaviors - You remain calm in stressful situations - when they held the belief that men would penalize them for being emotio nal or insecure. The researchers call these beliefs negative meta-stereotypes.Women may infer from a negatively meta-stereotyped trait that they would be assessed in accordance with the negative stereotypes recruiters hold about their social group. If this is perceived as a threat to their social identity, women job seekers would be less attracted to the job and refrain from applying, the researchers said.In a separate experiment, the researchers found that wording a listing as a trait would make a woman less likely to apply for a job. Thus, the researchers conclude that including rigid personality traits like You are calm as a job requirement underlines that the way job ads are written may have a discriminatory effect even when there is no discriminatory intent. Why getting the wording right in a job ad mattersIn the early recruitment stage of a job hunt, candidates have little information to base their decisions on, so verbal cues within job listings take on an outsized influence. Thats why asking for a ninja or a guru for your next hire can deter qualified applicants from applying. The bottom lineEverything - from how the role is framed to what words you choose to include - matters. Its a reminder for employers to spend as much time crafting their job listing to get the wording right as they do with any other component of the hiring process.

Nontechnical Skills for Accounting and Finance Jobs

Nontechnical Skills for Accounting and Finance JobsNontechnical Skills for Accounting and Finance JobsIn-demand technical abilities and certifications have long been the keys that open doors to top accounting and finance jobs. But today, many employers specifically seek experienced professionals who can bring a range of nontechnical skills to their position, as well.Once viewed primarily as nice-to-have qualities, soft skills - such as the ability to communicate effectively with non-finance audiences or to work collaboratively across departments - are now requirements for many accounting and finance roles. That includes consulting jobs.Carrie Wentling, resource specialist for Robert Half Management Resources and director of member services at Financial Executives International (FEI), says, Some of the attributes that employers value most in consultants are problem-solving, attention to detail, relationship-building and organizational skills. These abilities are critical for full-ti me as well as project-based work, as each assignment brings new challenges to work through - and new people to work with. She adds that flexibility and adaptability are also important qualities for consultants to possess. Being able to anticipate what is coming next - good or bad is also key, as Wentling explains Employers want consultants to analyze situations quickly, and clearly explain what needs to be done, and why and how. To deliver on that expectation, consultants need to have a strong mix of technical and soft skills, she says. The nontechnical skills that can help you stand outSome of the abilities that Wentling highlights, such as adaptability and flexibility, are also listed in our latest Salary Guide as in-demand skills for accounting and finance jobs. Following is a closer look at some of the nontechnical abilities that can help you advance your accounting and finance or consulting careerIntegrityThis character trait - albeit abstract - is important in any business s etting. But it is particularly critical for professionals who handle financial information, intellectual property and other sensitive data. Its also a top leadership trait In recent Robert Half Management Resources surveys, both workers in general and CFOs cited integrity as the most important attribute for business leaders to possess.Relationship-buildingWentling noted that relationship-building is important for both full-time positions and consulting careers. But any accounting and finance professional who invests the time to build trust and credibility with their colleagues and clients is likely to see career benefits stem from that effort. Mastering the art of relationship-building also can help you to understand others challenges and make more valuable contributions to an employer. It will enable you to be a more effective leader, as well.CommunicationThe nature of communication in business is changing rapidly due to new ways of sharing information, like social media and collab oration tools, and the growing volumes of data that companies are collecting and generating. The ability to synthesize and present financial data clearly and concisely has never been more critical for accounting and finance pros. So is the ability to maintain an effective two-way (i.e., talking and listening) dialogue with others inside and outside the organization. Polished public speaking skills are also valuable given the heightened profile of the finance function in businesses today.A commitment to continuous learningIndividuals who are dedicated to lifelong learning position themselves for more successful careers because theyre able to adapt to change more easily. As business needs and environments shift, naturally inquisitive accounting and finance professionals who are proactive about their development will find they are able to stay ahead of the curve, rather than struggle behind it. Plus, businesses today emphasize innovation and expect that mindset from everyone in the org anization, including the accounting and finance teams.Openness to diverse perspectivesAccounting and finance professionals, including finance leaders, must be able to interact and collaborate with people from dramatically different backgrounds - and different generations. Communicating with, motivating and persuading different parties can require varied approaches, as well as emotional intelligence - that is, the ability to identify and manage your emotions and the emotions of others. To advance your career, look for ways to build - and continually demonstrate - the above qualities to employers. Technical skills and certifications are still the things that hiring managers will look for first in the candidates they evaluate, according to Wentling. But demonstrated strength in the nontechnical areas that employers value and evidence of a strong work ethic can help to set you apart and allow you to take on positions of greater responsibility.Looking for consulting jobs in accounting and finance? You can departure your search for assignments right from our website. Spooky, Scary, Horrifying Resumes for Halloween

Spooky, Scary, Horrifying Resumes for Halloween Spooky, Scary, Horrifying Resumes for Halloween Resumes can be scary to create, but just as horrifying to read. Recruiters and hiring managers are subjected to comic sans, puke green font, typos, inappropriate headshots, and other terrorsBefore you submit your resume, really contemplate how youre presenting yourself. Go a step further and get a second opinion from a friend or upload it to Jobscan to check for best practices, red flags, and opportunities to improve. Here are three of the spookiest resumes we found for Halloween1. A ghostly resume designvia TwelveSkipThis job seekers resume design is appropriate considering hes looking to get his foot in the door in a role that utilizes his animation, design, and illustration skills. In fact, its expected. For the rest of us, getting too creative with our resume can do more harm than good.If artistic ability isnt parte of the job description, the hiring manager might wonder how serious you are about the job. And for all you know, they might just bedrngnis share the same sensibilities. Even worse, applicant tracking systems(ATS) would immediately bury a resume like this. When you apply through an ATS, recruiters can run searches for specific skills. For example, a recruiter might search for Photoshop. Nigel has the right resume keywords, but he might not come up as a match for a number of reasons. The ATS could have trouble processing this obscure resume font. ATS are also known to struggle with tables and columns, which are used throughout the resume. The information in these fields might not be properly parsed and considered for the search.Jobscan checks for resume keywords as well as other ATS traps like fonts, columns and more.2. Would you invite this monster to an interview?via Business InsiderWhen do you take a chance with an over-the-top resume design? Drawing this kind of attention can workEvery time I sent that resume out I got an interview without fail, Joe K elso told Business Insider. If I really wanted an interview somewhere, thats the one I would use.If youre physically handing out your resumes or emailing them directly to someone as part of your application, your resume is less likely to get hung up in an ATS. You can take more design liberties in these instances, especially if youre in a creative field. But 98% of Fortune 500 companies use ATSand even if you are able to network and deliver your resume directly to someone, you might still need to formally apply through the ATS. Make sure you have an ATS-friendly resume ready to go as a companion to your creative resume.3. The horror of the wrong attachmentvia BuzzfeedThis applicant meant to attach a zip file titled with a bunch of numbers, but instead attached a similarly titled image of actor Nicolas Cage doing his thing. This is a great example of why your resume file name matters Not only will it keep embarrassing mistakes (or hilarious viral content) from happening, its an opport unity to appear professional and organized. The file name will be visible, so take the extra second to rename your file to something like NicolasCageResume.docx or NicolasCageActor.docx.
